Position Requirements

  • LLB or related qualification
  • Extensive experience in the Legal Field
  • Completed Articles
  • Sound knowledge and understanding of local government is essential
  • Be a natural person
  • Be a citizen of the Republic of South Africa
  • Cannot be disqualified under regulation 4(5)
  • Valid code B or EB Driver’s license
  • Management skills
  • Strong leadership skills
  • Sound interpersonal and communication skills

Regulations 4(5) disqualifies the following persons  

  1. A person who has been convicted of an offence in terms of this regulation or any other legislation.
  2. A person who, whether in the Republic or elsewhere has been convicted of theft, fraud, forgery, the uttering of the forged document or any offence of which dishonesty is an element.
  3. A person who has at any time been removed from any office of trust on account of misconduct or dishonesty.
  4. An accounting officer of a municipality or municipal entity.
  5. A political office-bearer or member of a board of directors; and
  6. A person who is an office-bearer in a political party.

Objectives and Responsibilities:

 

In terms of Chapter 2 of the Municipal Regulations on Financial Misconduct, Procedures and Criminal Procedures, Government Gazette No. 37682 of May 2014 on Local Government: Municipal Finance Management Act,2003, the Govan Mbeki Local Council hereby invites applications from interested person to be appointed on a part-time basis to be a member of the Municipality’s Disciplinary Board. The Govan Mbeki Municipality has establish an Independent Advisory Body that will assist the Council with the investigations of allegations of financial misconduct, and provide further steps to be taken regarding disciplinary proceedings.

 

TERMS OF REFERENCE

 

A Disciplinary Board must:

 

  1. Complete the preliminary investigation and submit its report within 30 days or at the first sitting of Council, recommending that;
  2. The allegation(s) of financial misconduct has substance and warrant a full investigation, and
  3. An outside specific specialist should/should not be appointed as part of the team responsible for the full investigation, or
  • The Council take note that the allegation of financial misconduct was found frivolous and no grounds warrant a further full investigation.
  1. Once a full investigation is completed and the Disciplinary Board is satisfied that the allegations are founded and sufficient grounds for a charge of financial misconduct and/or financial offense exist, the Chairperson must submit the Disciplinary Board’s report to the designated person and Council.

 

TERM OF OFFICE 

The prospective member of the disciplinary committee will serve for a period not exceeding three (3) years.

 

REMUNERATION 

The remuneration of the disciplinary committee members is at the discretion of the Municipal Council and in compliance with treasury guidelines.

 

SEQUENCE OF MEETINGS 

A minimum of four meetings will be held in a financial year or at such other time as may be required.

 

The offer of remuneration will be determined by competencies, qualifications and experience as set out in Notice 1224 published in Government Gazette No. 42023 dated 08 November 2018, Upper Limits of Total Remuneration Packages payable to Municipal Managers and Managers directly accountable to Municipal Managers.

Qualification and employment verification as well as criminal record and credit record enquiries will be performed as part of the screening process for all shortlisted candidates.
